JAM Duo is owned and operated by JAM Music Group Ltd. References in these terms to “JAM Duo”, “we”, “us” or “our” mean JAM Music Group Ltd and the musicians performing as JAM Duo.

References to “you”, “your”, “the client” or “the hirer” mean the person or organisation making the booking and responsible for payment.

These terms form part of the agreement between you and JAM Duo. By confirming a booking and paying the booking fee or deposit, you agree to these terms.

1. Your Booking

Your booking is confirmed when:

  1. we have agreed the date, venue and services to be provided;
  2. we have issued written confirmation of the booking; and
  3. the required booking fee or deposit has been received.

The services included in your booking will be shown in your booking confirmation or invoice. Only the services specifically listed in that confirmation are included.

JAM Duo provides live cello and piano music. We do not perform with backing tracks.

Unless genuinely prevented by illness, emergency or circumstances outside our reasonable control, JAM Duo will comprise Anne-Marie Humphries on cello and Jules Addison on piano.

2. Wedding Music Options

Our wedding services are based on the parts of the wedding day that you have booked rather than providing uninterrupted music for the entire period that we are present at the venue.

Depending on your booking, your services may include:

  • the wedding ceremony;
  • extended guest-arrival music;
  • the drinks reception;
  • the wedding breakfast or meal;
  • a first dance or another separately agreed performance.

Each part of the day has its own performance allowance, as explained below.

Time required for unloading, setting up, packing away, moving equipment, waiting between different parts of the day and travelling between locations is not performance time.

3. Wedding Ceremony Music

For a wedding ceremony, we will normally arrive approximately 60 minutes before the scheduled ceremony time. This allows us to unload, set up, carry out the necessary checks and liaise with the venue, registrar, celebrant or officiant.

Our standard ceremony booking includes approximately 15 minutes of music while guests are seated in the ceremony space, followed by music for the relevant parts of the ceremony. This commonly includes:

  • the entrance or processional;
  • music during the signing of the register, where appropriate;
  • the exit or recessional.

Unless otherwise agreed, we base our planning on:

  • approximately 30 minutes for a civil ceremony; or
  • approximately 60 minutes for a church or religious ceremony.

You must tell us in advance if your ceremony is expected to be significantly longer, includes additional rituals or requires an unusually large amount of music.

Extended guest-arrival music of up to approximately one hour before the ceremony is available where this has been booked separately.

We are experienced in adapting processional music to the length of an entrance. We will liaise with the person responsible for giving the entrance cue and will make reasonable musical adjustments on the day.

4. Drinks Reception Music

Where drinks-reception music is included, JAM Duo will provide up to 90 minutes of live music during the drinks reception.

The 90-minute allowance begins when we are set up in the agreed drinks-reception location and begin the first piece of music.

We will normally play continuously or with only a brief natural pause where appropriate. We may also pause for announcements, photographs, speeches, venue instructions or other events taking place during the reception.

Time lost because the drinks reception starts late, guests remain elsewhere, photographs overrun or another supplier delays proceedings does not automatically extend the agreed 90-minute performance period or any later finishing time.

We will always try to be reasonably flexible where the wedding schedule changes slightly. A significant delay may, however:

  • reduce the amount of music we can provide;
  • affect a later part of your booking;
  • require an additional fee; or
  • prevent an extension where we have another commitment or substantial journey.

Additional drinks-reception music may be arranged in advance for a further fee.

5. Wedding Breakfast or Meal Music

Where music during the wedding breakfast or meal is included, JAM Duo will provide up to 90 minutes of live music during the meal.

The performance will normally begin when the couple is announced into the room, when guests are seated, or at another time agreed with you or the venue.

We usually perform until the earliest of:

  • 90 minutes of meal music having been provided;
  • speeches beginning;
  • dessert having been served;
  • the meal coming to an end; or
  • another agreed part of the wedding schedule beginning.

Speeches, announcements, games, presentations or other activities taking place during the meal may reduce the available opportunity for live music. Time during which we are asked or required to stop playing is not automatically added to the end of the performance.

Where speeches take place before the meal, the agreed music time will begin at the revised performance start time, subject to our availability and the remainder of the wedding schedule.

Additional meal music may be arranged in advance for a further fee.

6. Extending Drinks or Meal Music

The standard allowance is 90 minutes during the drinks reception and 90 minutes during the wedding meal where those services have been booked.

Additional time must normally be requested and agreed before the wedding. We will confirm the additional fee in writing.

Requests made on the wedding day are subject to:

  • our availability;
  • the venue schedule;
  • travel requirements;
  • other commitments;
  • the condition and safety of our equipment; and
  • payment of any additional fee requested.

We are not obliged to continue beyond the services and times included in the confirmed booking.

7. Delays and Changes to the Wedding Schedule

Wedding days do not always run precisely to schedule, and we will make reasonable efforts to adapt to ordinary delays.

Where we are present, set up and ready to perform at the agreed time, delays caused by the client, guests, venue or another supplier do not automatically extend the booked service.

A substantial delay may result in:

  • a shorter performance;
  • a later service being shortened;
  • part of the booking being omitted;
  • an additional charge for extended attendance; or
  • the original finishing time remaining unchanged.

We will discuss the most practical option with you or the venue representative wherever reasonably possible.

8. Moving Between Performance Locations

Where your booking involves more than one part of the wedding day, we may need to move instruments and equipment between rooms or outdoor areas.

It will normally take approximately:

  • five to ten minutes to pack down; and
  • five to ten minutes to set up and check the equipment in the new location.

Longer may be required where there are stairs, lifts, considerable distances, restricted access, large numbers of guests or separate buildings.

Moving and setup time is not included within the 90 minutes of drinks-reception music or the 90 minutes of meal music. The relevant performance allowance begins once we are set up and ready to play in that location.

The venue must provide safe and reasonable access between performance areas.

9. Instruments and Amplification

Our normal setup uses a Nord digital piano, Yamaha cello and professional Yamaha amplification.

Amplification allows us to provide a balanced and appropriate sound. It does not mean that the performance must be loud. We will set the volume according to the size of the space, the number of guests and the atmosphere required.

You must check whether the venue has:

  • any restriction on amplification;
  • a sound limiter;
  • a maximum permitted volume;
  • restrictions on electrical equipment;
  • restrictions affecting outdoor performances; or
  • any other rule that may affect live music.

You must provide accurate information about these restrictions before the wedding.

Our digital piano requires amplification. Where amplification is prohibited, we may only be able to perform using an acoustic cello and a suitable venue piano, where one is available and fit for use.

If we are prevented from providing the booked service because relevant venue restrictions were not disclosed to us, the agreed fee will remain payable.

10. Venue Pianos

Where we have agreed to use a venue piano, the venue or client is responsible for ensuring that it is:

  • available for our exclusive use at the required time;
  • in a suitable performance location;
  • in good working order;
  • properly tuned; and
  • of an appropriate professional standard.

We are not responsible for faults, poor tuning, mechanical problems or limitations associated with a venue instrument.

Where a venue piano proves unsuitable, we may use our own digital piano if access, space, power and amplification rules allow.

11. Performance Space, Access and Electricity

We normally require approximately two metres by one metre of level performance space.

Where our grand-piano shell is included, we normally require approximately two metres by two metres.

The performance area must be:

  • level and stable;
  • reasonably accessible;
  • protected from guests, drinks and passing service staff;
  • free from trip hazards;
  • away from direct heat sources;
  • sufficiently lit; and
  • close to a suitable electricity supply where amplified equipment is being used.

JAM Duo carries a portable power supply and can normally operate without access to venue electricity where necessary. However, the use of our own power supply must still be suitable for the location, duration and equipment required. Any known restrictions relating to electrical equipment or portable power supplies must be disclosed to us in advance.

We may adjust the exact position of our instruments where necessary for safety, access, sound quality or protection of equipment.

The client and venue must provide reasonable unloading access. Any material access restrictions, long carrying distances, stairs or parking difficulties must be disclosed before the wedding.

12. Outdoor Performances

We are happy to perform outside where conditions are suitable.

Our instruments, electrical equipment, music stands, tablets and the musicians must be protected from rain, moisture, excessive heat, strong wind and direct sunlight.

Suitable protection from rain may include:

  • a marquee;
  • a substantial fixed canopy;
  • an awning;
  • a covered terrace; or
  • another weatherproof structure agreed by us.

A tree, small parasol or our sun gazebo is not suitable protection from rain.

Our 2m x 2m navy blue gazebo is intended primarily to provide shade and is not a rain shelter.

The final decision about whether it is safe and appropriate to perform outside rests with JAM Duo. We may require the performance to be moved indoors because of rain, threatened rain, strong wind, excessive heat, cold, damp ground or any other condition that may place people or equipment at risk.

Where an outdoor performance cannot proceed safely, we will perform in a suitable indoor alternative where one is available. This will not constitute a cancellation or failure to provide the service.

13. Music Choices and Requests

You will be invited to provide your music choices and other wedding information through our online client form.

Music choices and special requests should be submitted no later than 30 days before the wedding unless another deadline has been agreed.

We are usually able to accommodate reasonable requests without charging a learning fee. However:

  • some pieces may not work effectively for cello and piano;
  • some requests may not be achievable within the available preparation time;
  • specialist sheet music or arrangements may need to be purchased; and
  • copyright or licensing restrictions may occasionally prevent a request.

Where a specific arrangement must be purchased, we may ask you to cover the reasonable cost. We will tell you before making the purchase.

Where choices are not supplied by the required deadline, we will select suitable music from our repertoire.

14. Singers, Instrumentalists and Other Performers

We may be able to accompany a singer, instrumentalist or other performer who is not part of JAM Duo, but this must be agreed in advance.

We will need sufficient notice to assess:

  • the music;
  • the key and arrangement;
  • the ability and requirements of the performer;
  • rehearsal requirements;
  • technical requirements; and
  • whether accompaniment is practical within the wedding schedule.

Additional rehearsals, arrangements, sound checks or meetings may involve a further fee.

No other performer may use our instruments, amplification, cables, microphones or other equipment without our express permission.

15. Photography, Videography and Audio Recording

We are pleased for photographers and videographers to capture JAM Duo as part of the general photography and filming of your wedding.

Permitted ambient recording

Ordinary ambient sound captured as part of a wedding film is permitted. This includes:

  • sound recorded using a camera’s built-in microphone;
  • an on-camera microphone used from a normal filming position; and
  • general room sound captured as part of recording the ceremony or wedding reception.

This permission is intended to allow the videographer to document the atmosphere of the wedding. It is not permission to make a separate or studio-style recording of JAM Duo’s performance.

Dedicated recording equipment

Unless we have given written agreement before the wedding, the following are not permitted:

  • attaching a microphone or recording device to either musician;
  • attaching equipment to a cello, piano, instrument stand or music stand;
  • placing microphones or recorders on, inside, underneath or immediately beside our instruments;
  • positioning a dedicated microphone close to or directly towards JAM Duo for the purpose of recording our performance;
  • taking a direct audio feed from our instruments, mixer, amplifier or speaker system;
  • connecting any recording equipment to our cables or equipment;
  • close-miking, multitrack recording or making an isolated audio recording of the performance; or
  • using equipment intended to create a new standalone or separately usable recording of JAM Duo.

The fact that a videographer has been engaged to produce a wedding film does not constitute prior permission for dedicated recording.

Responsibility for informing videographers

You are responsible for ensuring that your photographer, videographer, content creator and any other relevant supplier are made aware of this clause before the wedding.

Equipment must not be placed in our performance area without our permission. It must not obstruct the musicians, interfere with our equipment, create a trip hazard or affect the quality of our performance.

We may require any unauthorised recording equipment to be moved, disconnected or removed. We will not be responsible for any effect this has on a videographer’s recording, soundtrack or final deliverables.

Requests for a separate recording of a particular piece must be discussed with us in advance. We may be able to provide or create a suitable professional recording, subject to availability, copyright requirements and any applicable fee.

Nothing in this clause grants permission to commercially release, distribute, sell or publish a standalone recording of JAM Duo’s performance.

16. Breaks and Refreshments

The ceremony, 90-minute drinks-reception performance and 90-minute meal performance will not normally require a formal break, although we may pause briefly where appropriate.

Longer or extended bookings may require reasonable breaks. We will coordinate these with speeches, photographs, room changes or other natural pauses wherever possible.

For bookings involving a lengthy period at the venue, a supplier meal or light refreshments are appreciated but are not a contractual requirement unless specifically agreed.

Access to drinking water and toilet facilities must be available.

17. Fees and Payment

The total fee and payment schedule will be shown on your booking confirmation or invoice.

The booking fee or deposit secures the date and is normally non-refundable if you cancel, subject to your statutory rights and the cancellation provisions below.

The remaining balance is due 30 days before the wedding or event unless another date has been agreed in writing.

Payment must be made by bank transfer to the JAM Music Group Ltd business account shown on the invoice.

Failure to pay the balance by the due date may result in us suspending preparation or declining to perform. The outstanding contractual amount may remain payable.

18. Cancellation by the Client

Cancellation must be communicated to us in writing.

Where you cancel more than 30 days before the performance date, the booking fee or deposit will normally be retained, but no remaining balance will be payable unless a different arrangement has been agreed.

Where you cancel 30 days or fewer before the performance date, the full remaining balance will normally become payable.

These provisions reflect the work undertaken, the reservation of the date and the reduced opportunity to accept another booking. Where appropriate, we will take reasonable account of costs saved or replacement income obtained for substantially the same date and time.

Nothing in these terms affects any cancellation or refund right that you may have under applicable consumer law.

19. Changing the Date

Requests to change the wedding or performance date are subject to our availability and must be agreed in writing.

Where we are available, we may transfer the booking subject to:

  • any difference in our prices;
  • changed travel or accommodation costs;
  • changes to the services required; and
  • an administration or rescheduling fee where reasonable.

Where we are unavailable for the requested new date, the request will be treated as a cancellation by the client under section 18.

Moving the date does not automatically transfer the original price where the new date falls in a different pricing period or calendar year.

20. Changes to the Venue or Services

Any change to the venue, performance areas, ceremony time or services booked must be communicated to us as soon as possible.

Changes are subject to our availability and may result in a revised fee where they involve:

  • additional performance time;
  • additional travel;
  • overnight accommodation;
  • multiple venues;
  • more equipment;
  • additional setup or moving requirements; or
  • a materially longer period of attendance.

Reducing the services after booking does not automatically result in a reduction of the agreed fee, because the date and relevant part of the day will already have been reserved.

We will confirm any agreed change and revised fee in writing.

21. Illness, Emergencies and Cancellation by JAM Duo

We take reasonable precautions when planning travel and allow appropriate additional journey time.

If one member of JAM Duo is genuinely unable to perform because of illness, accident or emergency, we will discuss the available options with you. These may include:

  • providing an agreed substitute musician of an appropriate professional standard;
  • providing an alternative performance arrangement;
  • rescheduling where appropriate; or
  • cancelling and refunding the sums paid for services we cannot provide.

We will not send a substitute musician without informing you and seeking your agreement wherever reasonably possible.

If JAM Duo cancels the booking and cannot provide an agreed alternative, we will refund all sums you have paid to us. Subject to any liability that cannot legally be excluded, this refund will be the limit of our financial responsibility for the cancellation.

22. Circumstances Outside Our Reasonable Control

Neither party will be responsible for a failure or delay caused by circumstances genuinely outside their reasonable control.

These may include severe weather, road closures, major transport disruption, fire, flood, venue closure, government restrictions, civil emergency, serious accident or another comparable event.

We will communicate with you and take reasonable steps to find a practical solution.

Any refund, postponement or alternative arrangement will depend on:

  • whether the service can still be provided;
  • costs already reasonably incurred;
  • whether the booking can be transferred; and
  • the parties’ legal rights at the time.

Nothing in this section limits rights that cannot lawfully be excluded.

23. Safety and Conduct

We may stop or refuse to begin a performance where:

  • a performance area is unsafe;
  • electrical equipment or instruments are at risk;
  • guests or suppliers interfere with our equipment;
  • there is threatening, abusive or seriously inappropriate behaviour;
  • a person is dangerously intoxicated;
  • venue conditions breach relevant safety requirements; or
  • continuing would present a reasonable risk to a person or property.

We will attempt to resolve the issue before stopping where it is safe and reasonable to do so.

Where the problem is caused by the client, guests, venue or another supplier and cannot be resolved, the agreed fee will remain payable.

24. Damage to Equipment

The client is responsible for taking reasonable steps to prevent guests, children, venue staff and other suppliers from touching, moving or interfering with our instruments and equipment.

You may be responsible for the reasonable cost of repairing or replacing equipment where damage is deliberately or negligently caused by you, your guests or a supplier acting on your behalf.

This does not apply to ordinary wear, equipment failure or damage caused by JAM Duo.

25. Liability

Nothing in these terms excludes or limits liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation; or
  • any other liability that cannot legally be excluded.

Subject to the above, our total liability arising from the booking will not normally exceed the total amount paid or payable to us for the booking.

We are not responsible for indirect or consequential losses that were not reasonably foreseeable when the booking was made.

We are not responsible for the acts, omissions, equipment or services of venues, videographers, photographers, registrars, caterers, wedding planners or other independent suppliers.

26. Personal Information and Privacy

We use personal information to administer your enquiry, booking, payment and performance.

The ways in which we collect, use, store and share personal information are explained in the JAM Music Group Ltd Privacy Policy available on our website.

You are responsible for ensuring that the contact details you provide remain accurate and for telling us if they change.

27. Complaints

Any concern should be raised with us as soon as reasonably possible so that we have an opportunity to resolve it.

A complaint relating to the performance should normally be submitted in writing within 14 days of the wedding or event and should explain:

  • what happened;
  • when it happened;
  • the people involved; and
  • the outcome you are seeking.

We will investigate the matter and respond within a reasonable period.

28. Changes to These Terms

The terms applying to your booking are those provided or made available when the booking is confirmed.

We may update the standard terms displayed on our website for future bookings. A later website update will not materially change an existing confirmed booking unless:

  • the change is required by law;
  • the change benefits you; or
  • both parties agree to the change in writing.

Any special condition agreed specifically with you in writing will take priority over these standard terms where the two are inconsistent.

29. Severability

If any part of these terms is found to be invalid or unenforceable, the remainder of the terms will continue to apply.

30. Governing Law

These terms and the booking are governed by the law of England and Wales.

The courts of England and Wales will have jurisdiction, subject to any legal right you may have as a consumer to bring proceedings elsewhere within the United Kingdom.
